Terms and Conditions of rendering services by the UK Visa Application Center (further – the “Rules”)

I. General Terms and Conditions

1. The present Rules are developed on the basis of article 428 of the Civil Code of the Russian Federation and define terms and conditions of providing services on submission and delivery of applications to/from the British Embassy in Moscow, and also on enrolment of the biometric personal data of applicants with its further transfer to the British Embassy in Moscow by LLC «Interlink Service» (Legal address: 105094, Moscow, Semenovskaya emb., 2/1, bld. 1, premise VII, office 1. Taxpayer Identification Number/ Reason code for setting accounting 7701642721/770101001, Registration number 1067746262891) (further – «UK Visa Application Center»).

2. The applicant referred to under the present Rules is understood as a physical person submitting a visa application for entry clearance into the United Kingdom of Great Britain and Northern Ireland.

3. This service agreement is considered to be effective only after payment of the visa fee required for processing the visa application by the British Embassy in Moscow, and receipt of written acknowledgement about acquaintance and consent of the Rules signed by the applicant.

4. The Rules are placed in the commonly accessible area outside the UK Visa Application Center and on the information board inside the UK Visa Application Center premises.

5. The UK Visa Application Center can provide the applicants additional services. List and cost for the same with the terms and conditions is placed on the information boards. They are also specified on the website www.ukvac-ru.com.

6. The operation time of the UK Visa Application Center and the information on non-working days (holidays) are available on signboards, information boards and also on the website www.ukvac-ru.com.

7. The date and time to submit the application at the UK Visa Application Center should be booked by the applicant online by visiting UKBA web-site http://www.ukba.homeoffice.gov.uk after completing application form.


II. Rendering of services by UK Visa Application Center

1. The UK Visa Application Center is obligated:

1.1. To accept a set of documents prepared by an applicant for processing the visa application by the British Embassy in Moscow. An accounting report (1S receipt) is generated in duplicate after accepting the applicant’s documents and is duly signed by an authorized representative of the UK Visa Application Center and by the applicant. Apart from this, no other document confirming submission of the visa application will be given to the applicant. The list of documents and the information necessary for processing the visa application is available on the UKBA website http://www.ukba.homeoffice.gov.uk .;

1.2. To accept the visa fee necessary for the processing of the visa application by the British Embassy in Moscow and to transfer it to the British Embassy in Moscow within the following timeframes:

1.2.1. not later than the next working day – if documents are submitted in Moscow and St.-Petersburg;

1.2.2. not later than 2 (two) working days following the date of submission – if documents are submitted in other cities of the Russian Federation

1.3. To enroll applicants’ biometric personal data (electronic fingerprint scanning and digital photographing).

1.4. To organize transfer of the documents accepted from applicants to the British Embassy in Moscow within the following timeframes:

1.4.1. not later than the next working day from the date of submission – when documents are submitted in Moscow;

1.4.2. not later than 4 (four) working days from the date of submission from the applicant – when documents are submitted in other cities of the Russian Federation.

1.5. To receive all respective documents (passport, etc.) from the British Embassy in Moscow and to deliver them on schedule:

  -  to the owner of the document/applicant in person against signed receipt and on condition that the following documents are provided: internal passport of the Russian Federation or other document replacing it as per the current legislation of the Russian Federation; passport of a foreign citizen if an applicant is not a citizen of the Russian Federation; cash receipt; Invoice cum receipt; accounting report (1S). In case the passport of a foreign citizen is submitted for visa application processing, the documents can be collected with some other document proving the applicant’s identity, and the documents proving submission of the passport to the UK Visa Application Center (cash receipt, ICR, accounting report);

  -  to an authorized person on condition that the following documents are provided: original of the authorization letter issued in accordance with the current legislation of the Russian Federation; passport of the authorized person and its copy; cash receipt; ICR; accounting report; applicant’s passport copy. Authorization letter should include the following: applicant’s passport data, authorized person’s passport data, number of applicant’s international passport that should be collected.

2. Applicant is obligated:

2.1. To submit documents to the UK Visa Application Center for processing in accordance with the appointment booked online. The UK Visa Application Center cannot advise or give applicants information concerning preparation of the documents. The UK Visa Application Center is not responsible for the accuracy, completeness, content and/or credibility of these documents. The UK Visa Application Center can refuse to accept the document from the applicant if:

-  the visa fee is not paid;
-  the printed online application form is not presented;
-  the applicant’s photo meeting UKBA requirements is not presented;
-  a valid international passport of the applicant is not presented.
2.2. To pay the correct visa fee required for processing the visa application by the British Embassy in Moscow according to the procedure established in the present Rules.

2.3. In case of ordering additional services to pay additional service fees according to the procedure established in the present Rules.

2.4. To track the status of the visa application on the website www.ukvac-ru.com.

2.5. To collect the documents from the UK Visa Application Center within 30 (thirty) calendar days from the date of receipt at the VAC.
When the documents are not collected within the timeframes mentioned in the present item of the Rules, the UK Visa Application Center will return the applicant’s documents back to the British Embassy in Moscow.

3. Terms of rendering of services by the UK Visa Application Center

3.1. Timeframe for rendering services specified in items 1.1, 1.3 of the present Rules is the day of submission of documents in the UK Visa Application Center by an applicant.

3.2. Timeframe for rendering of services specified in item 1.5 of the present Rules depends on the time required by the British Embassy in Moscow to process the application.
The UK Visa Application Center is not responsible for the processing time at the Embassy.
All visa applications are assessed upon their individual merits and in accordance with the UK Immigration Rules, there can therefore be some unavoidable delays in processing documents by the British Embassy in Moscow. Therefore the UK Border Agency does not recommend that applicants make any unrefundable travel arrangements before getting a visa.


4. Payment policy

4.1. Visa fees charged by the British Embassy in Moscow for processing applications are established by the British Embassy in Moscow and specified on the UKBA website http://www.ukba.homeoffice.gov.uk.
The UK Visa Application Center will not accept responsibility for visa fees specified on any other Internet sites.

4.2. Price of additional services is specified in the Price-lists placed in the information board at the UK Visa Application Center and also on the website www.ukvac-ru.com. Price of additional services can be changed unilaterally.

4.3. The total amount of visa fee and additional services fees is paid by an applicant in cash at the UK Visa Application Center post completion of the submission formalities.

5. Refund Policy

5.1 The visa fee will not be refunded to the applicant by the British Embassy in Moscow/UK Visa Application Center in case of:

-   a refusal in issuing a visa to an applicant by the British Embassy in Moscow irrespective of the reasons for these actions
-   granting a visa for a shorter term than it was requested
-   withdrawal of the application from the British Embassy in Moscow.

The UK Visa Application Center is not responsible for any decision to issue a fee refund by the British Embassy in Moscow.

5.2 The visa fee will not be refunded to the applicant by the British Embassy in Moscow/UK Visa Application Center unless the application is withdrawn in writing before an applicant’s biometric data has been enrolled.

5.3 When a visa fee is refunded to an applicant (to the person whose name is specified in the UK Visa Application Centre report) by the British Embassy in Moscow, it will be processed only if the applicant provides the following documents:
-   cash receipt;
-   ICR;
-   accounting report;
-   applicant’s internal passport and its copy.

When a visa fee is refunded to an applicant by the British Embassy in Moscow, and it is collected by a nominative person, it will be processed only if the following documents are provided:
-  cash receipt;
-  ICR;
-  accounting report;
-  copy of applicant’s internal passport;
-  notarized authorization letter;
-  authorized person’s internal passport and its copy;
-  birth certificate (for a child visa application).

5.4. When a visa application is refused or an application is withdrawn by the British Embassy in Moscow for any reason, the cost of the additional services provided to the applicant by the UK Visa Application Center will not be refunded.

5.5. If an applicant has opted for courier delivery of the documents and later collects them in person at the UK Visa Application Center, the cost of the courier delivery additional service will not be refunded in case the UK Visa Application Center has made all the arrangements for the delivery to be done.

5.6. If a visa is issued for a shorter period than the applicant applied for, the difference in visa fee will not be refunded to the applicant by the British Embassy in Moscow /UK Visa Application Center.

6. Essential conditions of rendering of services by the UK Visa Application Center

6.1. Issuing a visa, non-issue of a visa and/or refusal of a visa is at the sole discretion of the British Embassy in Moscow.

6.2. The British Embassy in Moscow may request applicants to provide additional documents in order to process their applications or call applicants at their discretion for an interview at the British Embassy in Moscow

6.3. The British Embassy in Moscow can deliver/send documents directly to applicants using a courier service without transferring them to the UK Visa Application Center. In such cases the UK Visa Application Center will not assume responsibility for any loss and/or damage of the applicants’ documents.

6.4. The UK Visa Application Center takes every reasonable precaution to ensure safety of the documents submitted by applicants. However the UK Visa Application Center does not bear responsibility for any documents which are lost and/or damaged either while being processed in the British Embassy in Moscow, or in transit to/from the British Embassy in Moscow.

6.5. In case an applicant is not a citizen of the Russian Federation, it is the applicant’s responsibility to obey the rules of foreign citizens staying in the territory of Russia.

6.6. For services to be provided applicants or their official representatives should give their consent for processing personal and biometric data by signing the accounting report (1S). Applicants bear full responsibility for providing their biometric personal data to the UK Visa Application Center.

6.7. The UK Visa Application Center provides an applicant with two copies of the accounting report (1S) describing services provided which must be signed by an applicant, and one copy should be returned to the UK Visa Application Center duly signed on receipt or if unsigned with a written explanation why it is not signed. If the UK Visa Application Center does not receive the signed copy of the report or written claim from an applicant, the accounting report will be considered signed without claims, and the services of the UK Visa Application Center will be considered as having been provided properly and in time.

6.8. The UK Visa Application Center cannot be held responsible for the following:
-  Applicant’s personal belongings
-  Content and validity of a visa issued to an applicant
-   Refusal of a visa
-  Increase in processing timelines
-  If applicants needs to furnish additional documents/information as required by the British Embassy in Moscow
-  In case of any errors in applicants’ details or spelling mistakes in the issued visa
-  In case of any actions by immigration, customs or any other official bodies of the Russian Federation or any other foreign state preventing applicants from traveling with issued visas.

The present Rules can be changed by the UK Visa Application Center unilaterally. Changes in the Rules come into effect after publishing the updated version of the Rules on the website www.ukvac-ru.com and information board in the UK Visa Application Center.
